Commonwealth of Massachusetts v. National Institutes of Health (25-1343) (1st Cir. 2025)

On June 16, 2025, the AAUP filed an amicus brief in the First Circuit in support of over twenty states to affirm the district court’s injunction against a federal cap on NIH research grants. The brief argues that this cap on indirect-cost reimbursements would severely harm U.S. research institutions and faculty. The brief highlights that junior faculty, who rely on institutional support funded through these reimbursements, would be particularly affected—potentially unable to accept federal grants and forced to seek opportunities abroad. This could accelerate an ongoing “brain drain,” undermining the United States’ leadership in global scientific innovation.
