Ruling Allows Suits over Retaliation
By Gwendolyn Bradley
he U.S. Supreme Court ruled in March that individuals who protest sex discrimination may sue under Title IX of the Education Amendments if they experience retaliation as a result, even if they were not direct victims of the discrimination. Title IX prohibits discrimination in federally assisted education programs and activities. The case, Jackson v. Birmingham Board of Education, was brought by Alabama high school basketball coach Roderick Jackson, who was stripped of his coaching duties after he complained that his all-girl team, unlike the boys' team, had to practice in an inadequate facility and lacked adequate funds for game officials, equipment, and supplies. The AAUP, along with several coaching associations, had signed onto an amicus brief written by the National Education Association that supported Jackson. More details and an analysis of the case will appear in a Legal Watch column in the July-August issue.
